First off, Welcome to Creative Coy! By accessing or using this website (the “Site”), you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree, please discontinue use of the Site.

These Terms apply to all visitors, customers, and users of the Site.

1. About Creative Coy

Creative Coy provides original artwork, digital products, print-on-demand merchandise, and creative consulting services. The Site is owned and operated by Tara St. George, who manages all creative and business operations as an independent, single-person studio.

2. Use of the Website

By using the Site, you agree:

• Not to engage in illegal or fraudulent activity

• Not to attempt to interfere with the Site’s functionality

• Not to upload harmful code, spam, or abusive content

• Not to copy, distribute, resell, or exploit any part of the Site without permission

• Not to use the Site to harass, abuse, or impersonate others

You must be at least 18 years old to make purchases or enter into paid services.

3. Intellectual Property

All artwork, designs, products, text, graphics, logos, digital files, and other content on this Site are the intellectual property of Creative Coy unless explicitly stated otherwise.

You may not:

• Copy, reproduce, or redistribute artwork

• Resell or sublicense digital products

• Claim Creative Coy work as your own

• Use branding, logos, or designs without written permission

You may use purchased digital files according to the usage rights stated in the product description. Digital files include a "Readme" file that contains their license/usage rights.

4. Products and Services

Creative Coy currently offers physical products for customers located in the United States and Canada. Some services, including digital products, commissions, and consultations, may be available globally. Our offerings fall into several categories:

(a) Print-on-Demand Items

Certain physical items (such as mugs, prints, apparel, and merchandise) are manufactured and fulfilled by third-party providers such as Printful.

By purchasing these items, you acknowledge:

• Fulfillment times vary

• Colors may appear slightly different due to screen variations

• Printful’s production quality and timelines are outside our direct control

Eligibility for refunds or replacements is governed by our Refund Policy.

(b) Original Art (One-of-a-Kind Items)

Original artwork created by Creative Coy is unique and cannot be replaced. Any repair or restoration work, if possible, would be treated as a new commission and priced accordingly.

All original artwork is final sale.
No returns, refunds, or exchanges are offered except in cases of shipping damage.

(c) Digital Products

Digital downloads (PDFs, modules, artwork, templates, assets, etc.) are delivered electronically via email.

These products are non-refundable and cannot be returned.

If a file is corrupted or fails to download, we will assist in providing a working copy.

(d) Commissions

Custom art, illustrations, design work, and branding projects are handled individually.

Each commission includes its own written contract, which governs:

• Deliverables

• Timelines

• Revision terms

• Usage rights

• Refund or cancellation rules

If there is ever a conflict between these Terms and a signed contract, the contract controls.

(e) Consulting Services

Consultation sessions (creative, branding, game development, or business guidance) are billed for time and expertise.

Consulting services are non-refundable once the session occurs.

Contracts or agreements provided at booking take precedence over these Terms.

5. Payment and Billing

We accept payments through secure third-party processors such as Stripe and PayPal. For contracted services (such as commissions and consultations), payment is preferred in USD. However, we can accept CAD payments via PayPal upon request. If you wish to pay in CAD for a contracted service, you must notify us in advance so we can provide the correct PayPal information and pricing.

By completing a purchase, you agree to:

• Provide accurate billing and shipping information

• Authorize us to charge your chosen payment method

• Accept any applicable taxes or fees calculated at checkout
  

We do not store full credit card numbers.

Promotional discounts, when offered, apply only during the stated dates.

6. Order Processing and Fulfillment

For Printful-fulfilled products:

• Manufacturing time is typically 1–5 business days

• Shipping speed varies by location

• Items may ship separately depending on the order

• Tracking information will be provided when available
  

For original art, commissions, or other custom items, fulfillment timelines are detailed in the product description or contract.

7. Shipping, Returns, and Refunds

Shipping, refund, and return rules are fully described in our Shipping Policy and Refund Policy.

By making a purchase, you agree to the conditions in those policies, including:

• Print-on-demand items are replaced only for defects, damage, or printing errors

• Original artwork is final sale

• Digital products are final sale

• Commissions and consulting services are contract-governed and non-refundable

8. Disclaimer of Warranties

The Site is provided “as is” and “as available.”
We do not warrant that:

• The Site will always be available without interruptions

• Errors will always be corrected immediately

• The Site will be entirely free of viruses or security vulnerabilities

We make reasonable efforts to maintain accuracy but do not guarantee that all information (including product descriptions) is error-free.

9. Limitation of Liability

To the fullest extent permitted by law:

• Creative Coy is not liable for indirect, incidental, or consequential damages

• We are not responsible for delays caused by shipping carriers, manufacturers, or third-party services

• Our liability for any claim related to a purchase is limited to the amount you paid for that purchase

10. Governing Law

These Terms are governed by the laws of the State of Maryland (USA).

Any disputes will be resolved in the appropriate courts of Maryland.

11. Changes to These Terms

We may update these Terms from time to time. The “Last updated” date at the top of the page reflects the current version.

Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
